<p><b>1. Information on the agreement</b></p>
<p>1.1 Parties to the contract</p>
<p>This Software License Agreement (hereinafter referred to as "Agreement") is made and effective by and between BaseALT Ltd which owns the rights to

(hereinafter referred to as "Distribution") and you, the owner of a Distribution's copy.</p>
<p>1.1.1 This Agreement authorizes natural persons to use the Distribution.</p>
<p>1.1.2 This Agreement authorizes legal entities to use the Distribution provided that such legal entities have purchased licenses (or entered into a written license agreement).</p>
<p>1.2 Scope of the contract</p>
<p>This Agreement defines the rights of the owner of a Distribution's copy to use the Distribution and the specific computer programs that are part of the Distribution (hereinafter referred to as "Applications") to the extent specified in this Agreement.</p>
<p>1.3 Formation of the contract</p>
<p>This Agreement is a simple (non-exclusive) licensing contract for use of computer software made using the simplified procedure (a contract of adhesion). Use of the Distribution in ways specified in this Agreement implies acceptance of the Agreement's conditions by the user and entails the formation of the contract. In such a case, a written contract is deemed to have been concluded.</p>
<p>1.4 Transfer of the rights to third parties (Sublicense agreement)</p>
<p>This Agreement defines the rights of end users. This Agreement grants the right to sublicense the right to use the intellectual activity result (the Distribution) to third parties provided that such third parties are natural persons.</p>
<p>A permission to sublicense the right to use the Distribution to legal entities may be granted only under a specific agreement with BaseALT Ltd. To obtain rights to issue sublicenses to legal entities, systems integrators, distributors and OEM vendors should contact BaseALT Ltd at sales@basealt.ru for a written distribution contract.</p>
<p><b>2. Rights of the owner of a Distribution's copy</b></p>
<p>2.1 Rights to the Distribution</p>
<p>The Distribution includes both free and non-free components. Permissions to distribute the non-free components with BaseALT Ltd's distributions have been obtained from the respective copyright owners. BaseALT Ltd holds copyright to the Distribution as a composite work.</p>
<p>2.2 Use of free software included in the Distribution</p>
<p>All of the Free Software Applications included in the Distribution are accompanied with license agreements which permanently grant you free of charge the following non-exclusive rights valid in the territory of any country:
</p>
<ul>
<li><p>the right to use the Applications (copies of the Applications) on unlimited number of computers for any purpose;</p></li>
<li><p>the right to modify the Applications, the right to publish and distribute modifications free of charge or for a fee (you decide) according to the license terms for the original Applications;</p></li>
<li><p>the right to pass the Applications to third parties free of charge or for a fee (you decide) without paying royalty to copyright owners;</p></li>
<li><p>the right to obtain and study the source code of the Applications.</p></li>
</ul>
<p>For a period of three years from the date of this Agreement, BaseALT Ltd shall, upon your request, provide source code of any Free Software Application included in the Distribution for a fee that is not higher than cost of a physical copy of the source code.</p>
<p>2.3 Use of non-free applications included in the Distribution</p>
<p>Permissions to distribute each of the non-free Applications included in the Distribution with the BaseALT Ltd's Distribution and for end users to use these have been obtained from the respective copyright owners.</p>
<p>2.4 Use of the Distribution's design elements and text on its cover or box</p>
<p>BaseALT Ltd's rights to design elements of the Distribution and text on its cover or box are subject to copyright and trademark law. Using them in ways which, under the applicable legislation, require having the corresponding intellectual property rights is only possible with the written permission of BaseALT Ltd.</p>
<p>2.5 Other rights</p>
<p>The right of authorship, right to the name and other personal non-property rights that are not alienable according to the applicable national legislation or that are not granted to you under the applicable legislation or license agreements for the particular Applications included in the Distribution are preserved by their owners and are not granted to the owner of a copy of the Distribution.</p>
<p>2.6 Reports on use of the Distribution</p>
<p>BaseALT Ltd does not require reports regarding use of the Distribution from the owner of a copy of the Distribution.</p>
<p><b>3. Amenability of the parties</b></p>
<p>Copyright on the Applications that are part of the Distribution, including the exclusive right to allow use of the Applications, is subject to applicable copyright law, including applicable international agreements. The user is solely responsible for abiding by national legislation while using the Applications included in the Distribution.</p>
<p>BaseALT Ltd warrants the media used to ship the Distribution against manufacturing defects and will replace any media found defective.</p>
<p>Applications included in the Distribution are distributed in the hope that they will be useful but without warranty of fitness for any particular purpose. BaseALT Ltd is not liable for any damages, direct or indirect, arising out of the use of these Applications.</p>

<p><b>1. Сведения о договоре</b></p>
<p>1.1 Участники договора</p>
<p>Настоящий лицензионный договор (далее договор) заключается между ООО «Базальт СПО», обладателем прав на программное обеспечение <b>@PRODUCT_NAME_RU@</b> (далее ДИСТРИБУТИВ), и Вами, владельцем экземпляра ДИСТРИБУТИВА.</p>
<p>1.1.1 Настоящий лицензионный договор разрешает использование ДИСТРИБУТИВА физическим лицам.</p>
<p>1.1.2 Настоящий лицензионный договор разрешает использование ДИСТРИБУТИВА юридическим лицам, купившим лицензии (или заключившим лицензионный договор в письменной форме).</p>
<p>1.2 Предмет договора</p>
<p>Настоящий договор регулирует права владельца экземпляра ДИСТРИБУТИВА на использование ДИСТРИБУТИВА, а также включенных в состав ДИСТРИБУТИВА отдельных программ для ЭВМ (далее ПРОГРАММЫ) в установленных Договором пределах.</p>
<p>1.3 Заключение договора</p>
<p>Настоящий договор является договором о предоставлении простой (неисключительной) лицензии на использование программы для ЭВМ, заключаемым в упрощенном порядке (договор присоединения). Начало использования ДИСТРИБУТИВА пользователем, как оно определяется указанными условиями, означает его согласие на заключение договора. В этом случае письменная форма договора считается соблюденной.</p>
<p>1.4 Передача прав третьим лицам (Сублицензионный договор)</p>
<p>В настоящем договоре определены права конечных пользователей. Настоящим договором разрешается предоставлять право использования результата интеллектуальной деятельности (ДИСТРИБУТИВА) третьему лицу при условии, что оно является физическим лицом.</p>
<p>Для получения разрешения на предоставление права использования ДИСТРИБУТИВА юридическим лицам необходимо заключить с ООО «Базальт СПО» отдельный договор. Системным интеграторам, дистрибьюторам и OEM-производителям для получения прав на сублицензирование юридическим лицам следует обращаться в ООО «Базальт СПО» по адресу sales@basealt.ru для заключения письменного договора.</p>
<p><b>2. Права владельца экземпляра ДИСТРИБУТИВА</b></p>
<p>2.1 Права на ДИСТРИБУТИВ</p>
<p>ДИСТРИБУТИВ содержит как свободные, так и несвободные компоненты. На распространение несвободных компонент в составе дистрибутивов ООО «Базальт СПО» получены соответствующие разрешения правообладателей. Авторские права на ДИСТРИБУТИВ как составное произведение принадлежат ООО «Базальт СПО».</p>
<p>2.2 Использование свободных программ, включенных в состав ДИСТРИБУТИВА.</p>
<p>Все СВОБОДНЫЕ ПРОГРАММЫ, включенные в состав ДИСТРИБУТИВА, сопровождаются лицензионными договорами, бессрочно и безвозмездно предоставляющими Вам следующие неисключительные права, действующие на территории любой страны:</p><ul><li><p>право эксплуатировать ПРОГРАММЫ (пользоваться экземплярами ПРОГРАММ) на неограниченном количестве компьютеров в любых целях; </p></li><li><p>право модифицировать ПРОГРАММЫ, а также публиковать и распространять модификации на безвозмездной или возмездной основе (по Вашему усмотрению) на условиях лицензии исходной ПРОГРАММЫ; </p></li><li><p>право передавать ПРОГРАММЫ третьим лицам на безвозмездной или возмездной основе (по Вашему усмотрению) без каких-либо отчислений владельцам авторских прав; </p></li><li><p>право беспрепятственно получать и изучать исходные тексты ПРОГРАММ. </p></li></ul><p>ООО «Базальт СПО» в течение трех лет с начала действия настоящего договора обязуется предоставить исходные тексты любой СВОБОДНОЙ ПРОГРАММЫ, включенной в состав ДИСТРИБУТИВА, по Вашему требованию за плату, не превышающую стоимость физического предоставления исходного текста.</p>
<p>2.3 Использование несвободных программ, включенных в состав ДИСТРИБУТИВА.</p>
<p>На все несвободные ПРОГРАММЫ, включенные в состав ДИСТРИБУТИВА, получены разрешения правообладателей на распространение этих ПРОГРАММ в составе ДИСТРИБУТИВА и на использование конечными пользователями.</p>
<p>2.4 Использование элементов оформления ДИСТРИБУТИВА и текстов на его обложке или коробке</p>
<p>Права ООО «Базальт СПО» на элементы оформления ДИСТРИБУТИВА и тексты на его обложке или коробке охраняются 4 Частью ГК РФ. Их использование способами, которые в соответствии с применимым законодательством требуют наличия интеллектуальных прав, возможно только в случае получения письменного согласия ООО «Базальт СПО».</p>
<p>2.5 Иные права</p>
<p>Право авторства, право на имя и иные личные неимущественные права автора, являющиеся неотчуждаемыми в соответствии с применимым национальным законодательством либо не предоставленные Вам применимым законодательством или лицензионными договорами на отдельные ПРОГРАММЫ, включенные в состав ДИСТРИБУТИВА, сохраняются за их обладателями и не предоставляются владельцу экземпляра ДИСТРИБУТИВА.</p>
<p>2.6 Отчет об использовании ДИСТРИБУТИВА</p>
<p>ООО «Базальт СПО» не требует от владельца экземпляра ДИСТРИБУТИВА предоставления отчетов об использовании ДИСТРИБУТИВА.</p>
<p><b>3. Ответственность сторон</b></p>
<p>Авторские права на входящие в состав ДИСТРИБУТИВА ПРОГРАММЫ, включая исключительное право разрешать использование ПРОГРАММ, охраняются применимым законодательством об авторском праве, включая применимые международные договоры об авторском праве. Вся ответственность за соблюдение национальных законов при использовании включенных в ДИСТРИБУТИВ ПРОГРАММ лежит на пользователе.</p>
<p>ООО «Базальт СПО» гарантирует замену носителей ДИСТРИБУТИВА при наличии производственного брака носителя.</p>
<p>ПРОГРАММЫ, включенные в состав ДИСТРИБУТИВА, распространяются в надежде, что они будут полезны, но без гарантии их пригодности для какой-либо конкретной цели. ООО «Базальт СПО» не несет ответственности за возможный ущерб, прямой или косвенный, понесенный в результате использования этих ПРОГРАММ.</p>
